All individuals currently or formerly employed by La-Z-Boy Inc. and LZB Retail, Inc. (La-Z-Boy Furniture Galleries) (“La-Z-Boy”) in the State of California as hourly non-exempt employees at any time from November 11, 2017, through the time of trial in this action. 

What are the allegations? 

The complaint alleges (1) failure to pay all minimum wages, (2) failure to pay all overtime wages, (3) meal period violations, (4) rest period violations, (5) untimely payment of wages, (6) wage statement violations, (7) waiting time penalties, (8) failure to reimburse business expenses, and (9) violations of the Unfair Competition Law.

Case Summary:

Plaintiff alleges La-Z-Boy miscalculated and underpaid overtime wages, because of an inaccurate “regular rate of pay” calculation method. La-Z-Boy edited time records, such that Plaintiff and other employees were not paid for work performed during their unpaid 30 minute meal periods. La-Z-Boy allegedly did not pay meal premiums for late, short, or missed meal periods evident on the face of employment and payroll records. La-Z-Boy required Sales Associated and other hourly employees to use their personal cell phones but did not issue a reasonable reimbursement or stipend for each use to Plaintiff or Class Members.
